Mythbuster: “I can claim directly from the RAF, so I do not need an attorney”

It is true that a person may lodge a direct claim with the Road Accident Fund. That does not mean it is always the safest or best route.

A direct claim may seem simple at first. The risk is that an injured person may not know whether the claim is being properly considered, whether the compensation offered is fair, or whether the long-term consequences of the injuries have been taken into account.

This is especially important where a person has suffered serious injuries, cannot work as before, needs ongoing medical care, or has lost a breadwinner in a road accident.

Without legal assistance, a claimant may also struggle to understand what documents are needed, which medical experts should be consulted, how damages are calculated and whether the RAF’s offer reflects the full value of the claim.

Direct claims may be rejected, under-settled or delayed until important time periods become a concern. Fair compensation depends heavily on proper medical expert evidence.
